DRAFT — requires review by a qualified solicitor before launch
This document is a working draft prepared for BonBon Estate. It has not yet been reviewed or approved by a qualified solicitor and must not be relied upon until that review is complete and all [SET BEFORE LAUNCH] company details have been filled in.
These Terms of Service (“Terms”) govern your use of the Bonbong Estate website and the services available through it. They form an agreement between you and [SET BEFORE LAUNCH] Bonbong Estate Ltd (company number [SET BEFORE LAUNCH] 00000000, registered office [SET BEFORE LAUNCH] 1 Example Street, London, EC1A 1AA, United Kingdom).
By using the website, creating an account or booking any of our services you agree to these Terms. If you do not agree, please do not use the website.
1. Who we are and how to contact us
[SET BEFORE LAUNCH] Bonbong Estate Ltd, trading as Bonbong Estate, is an estate agency operating in the United Kingdom. You can contact us at [SET BEFORE LAUNCH] info@bonbongestate.com or by phone on [SET BEFORE LAUNCH] +44 20 0000 0000.
2. Our service
The website lets you search and view property listings, book viewings, request property valuations, save favourite properties, contact our team and subscribe to property updates.
Content on the website (including valuations, guides and market commentary) is provided for general information only and does not constitute financial, legal, surveying or other professional advice. You should obtain independent professional advice before making property decisions.
3. Your account
You must be at least 18 years old to create an account. You agree to provide accurate, current information and to keep it up to date.
You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at [SET BEFORE LAUNCH] support@bonbongestate.com if you suspect unauthorised use. We may suspend or close accounts that breach these Terms.
4. Property listings and particulars
Property particulars (including descriptions, photographs, floor plans, prices and availability) are prepared from information supplied by sellers, landlords or their representatives. We take care to publish accurate information, in line with our obligations under consumer protection law, but we do not verify every detail and cannot guarantee completeness or accuracy.
Listings are an invitation to enquire only. They do not constitute an offer, a contract or any part of one, and no listing content is a statement of fact on which you may rely without verification. You must satisfy yourself as to the condition and suitability of any property by inspection, survey and your own legal advisers before committing to a purchase or tenancy.
5. Viewings, bookings and valuations
Viewing and appointment requests made through the website are requests only and are not confirmed until we or the relevant agent confirms them with you.
Online valuation estimates are generated from limited information you provide and from market data. They are an indicative guide only — they are not a formal RICS (“Red Book”) valuation, a survey, or advice, and must not be relied on for lending, tax, insurance or transaction decisions.
6. Acceptable use
When using the website you must not:
- use it for any unlawful or fraudulent purpose, or submit false enquiries, bookings or listings;
- scrape, harvest or bulk-download listings or personal data, or use automated tools to access the site beyond ordinary search-engine indexing;
- upload or transmit malware, attempt to gain unauthorised access to our systems, or interfere with the website’s operation;
- infringe anyone’s intellectual property or privacy rights, or post unlawful, defamatory or misleading content.
7. Intellectual property
The website and its content (including text, branding, photography, design and software) are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, revocable licence to access and use the website for personal, non-commercial purposes. No other rights are granted.
8. Third-party links and services
The website may link to third-party websites and services (for example map providers or mortgage calculators). We are not responsible for their content, terms or privacy practices.
9. Our liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you use our services as a consumer, nothing in these Terms affects your statutory rights.
The website itself is provided free of charge. To the fullest extent permitted by law, we exclude all implied conditions, warranties and representations in relation to the website, and we are not liable for loss of profit, business, goodwill or data, or for any indirect or consequential loss, arising from your use of (or inability to use) the website or your reliance on its content.
Where we provide paid estate agency services to you, the terms of the relevant agency agreement apply to those services in addition to these Terms.
10. Suspension and termination
We may suspend or withdraw the website, or suspend or terminate your access, where reasonably necessary — for example for maintenance, security, or where we reasonably believe you have breached these Terms. You may close your account at any time by contacting [SET BEFORE LAUNCH] support@bonbongestate.com.
11. Changes to these Terms
We may amend these Terms from time to time. The “Last updated” date at the top shows the current version. Changes apply from the date they are posted; your continued use of the website after that date constitutes acceptance. If a change materially affects registered users, we will take reasonable steps to notify you.
12. Governing law and jurisdiction
These Terms, their subject matter and formation are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — except that if you are a consumer resident elsewhere in the United Kingdom you may also rely on the mandatory consumer protections, and bring proceedings in the courts, of that part of the UK.
13. Complaints and redress
If you have a complaint about our service, contact [SET BEFORE LAUNCH] support@bonbongestate.com and we will follow our complaints procedure. We are a member of an approved redress scheme as required for estate agents in England: [SET BEFORE LAUNCH] The Property Ombudsman (TPO), membership no. TBC. If we cannot resolve your complaint, you may refer it to that scheme.
